I purchased a case pack of an item direct from a manufacturer. They told me they are the only authorized seller on Amazon, so I thought OK I will just sell them on eBay. Then I check the Amazon listing and there are 5 other sellers also selling this item.

I purchased a case pack of an item direct from a manufacturer. They told me they are the only authorized seller on Amazon, so I thought OK I will just sell them on eBay. Then I check the Amazon listing and there are 5 other sellers also selling this item. This puzzled me. My question is can I legitimately re-sell this item on Amazon? Under what circumstances can Amazon send me a C&D? As long as I can prove I’m not selling counterfeit goods my thought was I can sell the item. I never signed a MAP agreement or otherwise.

If you are not an authorized seller, the company can always decline to honor any warranty on the item. If the item has a warranty, and you are selling an item that effectively does not have a warranty, you are not selling exactly the same item that is in the listing. If the item doesn’t have a warranty, then forget what I just said.

IN any event, if you sell them on Amazon, don’t count on being able to buy from them again.

Companies definitley have ways to figure out where their stuff is being sold if being sold on non approved channels.
