When a new product says patent pending can a person still get in trouble for copying idea but not exact? I cannot find any patent pending on the gov site for this item, but their website says patent pending. Also doesn’t it take like 3 yes to get a patent? I could sell a ton until then, can’t I??

Best to set up a “consultation” meeting with a patent attorney. They can usually do a “quick search” using a paralegal for under $500 which is a good value. If there is a patent on it you could get sued and have to hire a lawyer to defend yourself, costing you thousands. The patent center has a website but its cumbersome to search unless you have experience.

Yes, when something is under going a patent registration, the idea of the patent itself is still protected.
